Services Available. The Gray Card Benefits as described in the Enrollment Agreement include discounts on various travel, leisure, and vacation related services, including discounts on resort accommodations, amusement parks, leisure trips, activities, tours, sightseeing, watersports, skiing, and other activities, which may change from time to time. A current list of Benefits and associated discounts is available at www.mygraycard.com/experiences. All Benefits may be accessed online through the Gray Card website and are redeemable through the applicable third-party vendor. You may be required to present Your Gray Card ID to redeem Your discount and Benefits. Amounts paid for redemption of specific Benefits are paid directly to the applicable third-party vendor. No goods are offered through the Benefits and there are no freight, delivery, or set up charges associated with the Benefits.
Limited Warranty. ADMINISTRATOR AND THE PROVIDERS PROVIDE THE BENEFITS AND THE PROGRAM, THESE AND OTHER MATERIALS, AND OTHER SERVICES AND PRODUCTS "AS-IS" AND, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXPRESSLY DISCLAIMS ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DESIGN, ACCURACY, CAPABILITY, SUFFICIENCY, SUITABILITY, CAPACITY, COMPLETENESS OR AVAILABILITY.
No Actions. No stockholder, director, officer or general or limited partner or any person or business entities exercising control or any beneficial interest in GCE has: (i) has been held liable in a civil action by final judgment or consented to the entry of a stipulated judgment if the civil action alleged fraud, embezzlement, fraudulent conversion, or misappropriation of property, a violation of applicable state seller of travel or discount buying acts, the use of untrue or misleading representations in an attempt to sell or dispose of real or personal property, or the use of unfair, unlawful, or deceptive business practices; (ii) been convicted of a felony or misdemeanor or pleaded nolo contendere to a felony or misdemeanor charge, if it involved fraud, embezzlement, misappropriation, fraudulent conversion of property or violation of applicable state seller of travel or discount buying acts; or (iii) is subject to any currently effective injunction or restrictive order relating to business activity as the result of an action brought by a public agency or department, including, but not limited to, an action affecting any vocational license.
Cancellation of Travel Services for California Residents. Upon cancellation of the transportation or travel services regarding the Benefits, where the passenger is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the passenger, all sums paid to the seller of travel for services not provided will be promptly paid to the passenger, unless the passenger advises the seller of travel in writing, after cancellation. This provision does not apply where the seller of travel has remitted the payment to another registered wholesale seller of travel or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon transportation or service. In this situation, the seller of travel must provide the passenger with a written statement accompanied by bank records establishing the disbursement of the payment, and if disbursed to a wholesale seller of travel, proof of current registration of that wholesaler.
